Section-5. हिन्दू विवाह के लिए शर्तें. –

दो हिन्दुओं के बीच विवाह अनुष्ठापित किया जा सकेगा यदि निम्नलिखित शर्तें पूरी हो जाएं, अर्थात् :-

(i) विवाह के समय दोनों पक्षकारों में से, न तो वर की कोई जीवित पत्नी हो और न वधू का कोई जीवित पति हो;

(ii) विवाह के समय दोनों पक्षकारों में से कोई पक्षकार-(ii) (क) चित्त-विकृति के परिणामस्वरूप विधिमान्य सम्मत्ति देने में असमर्थ न हो; या(ii)

(ख) विधिमान्य सम्पत्ति देने में समर्थ होने पर भी इस प्रकार के या इस हद तक मानसिक विकार से पीड़ित न रहा हो कि वह विवाह और सन्तानोत्पत्ति के लिए अयोग्य हो; या

Section- 5. Conditions for a Hindu marriage.-

Amarriage may be solemnized between any two Hindus, if the following conditions are fulfilled, namely:-

(i) neither party has a spouse living at the time of the marriage;

(ii) at the time of the marriage, neither party-(ii) (a) is a incapable of giving a valid consent to it in consequence of unsoundness of mind; or

(ii) (b) though capable of giving a valid consent, has been suffering from mental disorder of such a kind or to such an extent as to be unfit for marriage and the procreation of children; or

(ii) (c) has been subject to recurrent attacks of insanity [x x x];

(iii) the bridegroom has completed the age of twenty-one years and the bride the age of eighteen years at the time of the marriage;

(iv) the parties are not within the degrees of prohibited relationship, unless the custom or usage governing each of them permits of a marriage between the two;

(v) the parties are not sapindas of each other, unless the custom or usage governing each of them permits of a marriage between the two.
